Terms of Use

This is a legally binding agreement that affects your rights. Please read it carefully.

RawDream.com is a website ("Website") operated by RawDream.com (hereinafter collectively referred to as "RawDream"). By using the Website you agree to be bound by these Terms of Use (this "Agreement"), whether or not you register as a member ("Member"). Your agreeing to this Agreement is a required condition of use of the Website and participation in RawDream. If you do not agree to this Agreement, RawDream does not consent to your use of the Website or participation in RawDream, and you should discontinue using the Website immediately.

1. Content.

The Website includes the capability for users to upload, post, publish, display, transmit through, or otherwise submit (hereinafter "submit") materials of their own choosing ("Content"), including but not limited to text, photographs, pictures, music, videos, and so on. You agree that:

a. You are solely responsible for any Content that you submit.

b. RawDream may review and delete any Content that, in its sole judgment, violates this Agreement or which may be offensive, illegal, or violate the rights of, harm, or threaten the safety of others.

c. Following is a partial list of Content that is prohibited on the Website. RawDream reserves the right to investigate and take appropriate action to remedy violations of this provision, including without limitation, removing the offending Content and revoking the Membership of violator(s). Prohibited Content includes Content that:

i. is unlawful;

ii. involves exploitation of minors under the age of 18 in a sexual or violent manner, or solicits personal information from minors;

iii. provides instructional information about illegal or dubious activities such as making or buying weapons or devices of destruction, chaos, or terror, violating someone's privacy, techniques of defraud, or providing or creating computer viruses;

iv. is patently offensive or promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual;

v. harasses or advocates harassment;

vi. promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous;

vii. contains offensive nudity;

viii. involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";

ix. promotes an illegal or unauthorized copy of copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

x. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);

xi. solicits passwords or personal identifying information from other users for commercial or unlawful purposes; or,

xii. involves commercial activities or sales without the prior written consent of RawDream, such as contests, sweepstakes, barter, advertising, multilevel marketing, or pyramid schemes.

d. You are encouraged to notify RawDream if you encounter any Content on the Website you believe may violate this Agreement.

e. Content submitted to a publicly visible area of the Website becomes the property of RawDream. You waive all right, title, and interest in such Content. In the event the foregoing is unenforceable, you hereby grant RawDream a non-exclusive, fully paid, irrevocable, worldwide license to use, publicly perform, display, and otherwise exploit such Content on the Website and elsewhere.

2. Membership.

a. By registering for Membership on the Website, you represent and warrant that:

i. all registration information you submit is truthful and accurate and you will maintain the accuracy of such information;

ii. you are at least 18 years of age and you are capable and legally empowered to enter into binding legal agreements; and,

iii. your use of RawDream shall not violate any applicable laws or regulations.

b. If you are a minor and misrepresent your age, RawDream disclaims all liability for the consequences whatsoever, and your Membership may be revoked immediately without notice or warning.

c. Your Membership is solely for your personal use, and you shall not authorize or willingly permit others to use your Membership account, including your profile or email address. Your password is used to uniquely identify you to the Website, and should not be shared.

d. You are solely responsible for all Content submitted or displayed through your Membership, including personal and email messages, and for your interactions with other Website users.

e. In order to protect Members from unsolicited advertising or solicitation, junk messages, and spam, RawDream reserves the right to restrict the number or rate of personal and email messages a Member may send through the Website.

f. Membership is currently offered as a free service. RawDream reserves the right to charge a fee for Membership, or any part or subset of services thereof, at a future time.

g. RawDream reserves the right to refuse any Membership request or revoke any existing Membership, with or without cause, at its sole discretion, at any time without notice or warning, and without obligation to disclose the reason(s) for refusal or revocation, if any.

h. You may relinquish your Membership at any time.

i. You may not sell or otherwise transfer your Membership.

j. Membership is void where prohibited.

3. Prohibited Use.

The Website is for your personal use only and may not be used or accessed in any of the prohibited manners that appear below. Violation of this section may result in RawDream's taking appropriate action to remedy the violation, including but not limited to removal of offending material(s), if applicable, and revocation of Website or Membership privileges. Prohibited uses of the Website include:

a. violation of applicable laws and regulations;

b. use of any information obtained or derived from the Website to harass, abuse, or harm another person, or to contact, advertise to, solicit, or sell to others;

c. commercial endeavors, advertisements, affiliate links, and other forms of solicitation (except those that are specifically endorsed or approved by RawDream in writing);

d. advertising to, or solicitation of, any Member to buy or sell any products or services through the Website;

e. sending or distributing unsolicited commercial or junk messages (spam);

f. accessing the Website via any automated method;

g. access patterns or attacks designed to alter or interfere with natural access to the Website, such as "denial of service" attacks;

h. collecting user names or email addresses of Members by electronic or other means;

i. framing of or linking to the Website that disguises or attempts to disguise the true origin or source of the Website and its content;

j. covering, obscuring, or otherwise rendering invisible any advertisements on the Website via HTML, CSS, or any other means;

k. impersonating or attempting to impersonate another; and,

l. using the account, user name, or password of a Member other than yourself.

4. Proprietary Rights.

RawDream owns and retains all proprietary rights in the Website. The Website contains copyrighted material, trademarks, and other proprietary information of RawDream. Except for that information which is in the public domain or for which you have the written permission of RawDream, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

5. Copyright Policy.

You may not submit, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining prior written consent from the owner of such material. It is the policy of RawDream to revoke the Membership of any Member who repeatedly infringes copyright upon prompt notification to RawDream by the copyright owner or the copyright owner's legal agent.

If you believe that your work has been copied and submitted to the Website in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

a. an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

b. a description of the copyrighted work that you claim has been infringed;

c. a description of where the material that you claim is infringing is located on the Website;

d. your address, telephone number, and email address;

e. a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and,

f. a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

RawDream's Copyright Agent for notice of claims of copyright infringement can be reached via the "Contact Us" area of the Website.

6. Health or Medical Claims or Information.

You are strongly urged to independently and diligently research and educate yourself regarding any health or medical claims or information you may encounter on the Website. Only you can know what's best for you. Consult with your physician before taking any action that could affect your health.

7. Disclaimers.

RawDream is not responsible for any incorrect or inaccurate information on the Website, whether caused by users of the Website, Members, or by any equipment or programming associated with or utilized by the Website. RawDream is not responsible for the conduct, online or offline, of any Website user or Member. RawDream assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any user or Member communication. RawDream is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including any injury or damage to users or Members or to any person's computer related to or resulting from participation or downloading materials in connection with the Website. Under no circumstances shall RawDream be responsible for any loss or damage, including personal injury or death, resulting from use of the Website or from any Content submitted to the Website or transmitted to Members, or any interactions between users of the Website, whether online or offline. The Website and the Service are provided "AS-IS" and RawDream expressly disclaims any warranty of fitness for a particular purpose or non-infringement. RawDream cannot guarantee and does not promise any specific results from use of the Website.

8. Limitation of Liability.

IN NO EVENT SHALL RAWDREAM BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, EVEN IF RAWDREAM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, RAWDREAM'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO AMOUNT PAID, IF ANY, BY YOU TO RAWDREAM.

9. Indemnity.

You agree to indemnify and hold RawDream, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Website or Membership in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.

By participating in any offline RawDream event, you agree to release and hold RawDream harmless from any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, either directly or indirectly related to or arising from your participation in any such event.

10. Changes.

RawDream reserves the right to modify this Agreement at any time without notice or warning, and such modification shall be effective upon display on the Website (at http://rawdream.com/home/terms_of_use.php). Your use of the Website demonstrates and constitutes your agreeing to be bound by the Agreement in effect at the time of use.

11. Term.

This Agreement shall remain in full force and effect while you use the Website and/or are a Member. RawDream may terminate this Agreement at any time. Sections 1, 4, 6, 7, 8, 9, and 12 shall survive termination of this agreement.

12. Governing Law and Venue.

This Agreement and any dispute shall be governed by the laws of the state of Washington, United States, without regard to conflict of law provisions. You agree to personal jurisdiction by and venue in the area in the state of Washington, United States.

13. Other.

This Agreement constitutes the entire agreement between you and RawDream regarding use of the Website. The failure of RawDream to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no effect. RawDream is a trademark of RawDream.com.
